Terms & Conditions

These Terms & Conditions govern your use of SaveMyDigital Inc. ("SMD", "we", "us", "our") websites, member portal, assessment tools, certification programs, and related services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these terms.

If you do not agree, do not use the Services.

1. Eligibility & Accounts

• You must be at least 18 years old and capable of forming a binding contract under applicable law.
• You agree to provide accurate, current, and complete information during registration and keep it updated.
• You are responsible for safeguarding your account credentials and for all activity under your account.
• We may suspend or terminate accounts that violate these terms or that we determine, in our sole discretion, are harmful to other users or the Services.

2. Subscriptions & Payments

• Paid plans renew automatically until cancelled. Fees are billed in advance on a recurring basis.
• All prices are quoted in Canadian dollars (CAD) unless otherwise stated and are subject to applicable taxes.
• Refunds are provided in accordance with applicable consumer protection laws. For annual subscriptions, cancellations take effect at the end of the current paid period.
• We may change pricing with reasonable advance notice posted within the Services.

3. Certification & Advisor Program

• The SaveMyDigital Certified Advisor™ program ("Advisor Program") requires successful completion of training modules, quizzes, and any additional requirements specified by SMD.
• Certification status may be revoked for violation of program rules, ethics standards, or these terms.
• Advisors act independently and are not employees, agents, or legal representatives of SMD unless expressly agreed in writing.
• Advisors may participate in referral and earnings programs subject to separate program terms disclosed within the member portal.
• Illustrative advisor-to-customer ratios, ARPU, and earnings projections are examples only and do not guarantee actual results.

4. Intellectual Property

• All content, trademarks, logos, software, and materials provided through the Services are owned by SMD or its licensors and are protected by intellectual property laws.
• You may access and use the Services for personal, non-commercial purposes unless otherwise permitted. Reproduction, distribution, modification, or creation of derivative works without prior written consent is prohibited.

5. User Content & Conduct

• You retain ownership of content you submit, but grant SMD a worldwide, non-exclusive, royalty-free license to use, reproduce, and display such content as needed to provide the Services.
• You agree not to misuse the Services, interfere with their operation, or attempt unauthorized access.

6. Limitation of Liability

• The Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory.
• To the fullest extent permitted by law, SMD and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or goodwill.
• Nothing in these terms excludes liability that cannot be excluded by applicable law.

7. Indemnification

You agree to indemnify and hold harmless SaveMyDigital Inc. and its affiliates from any claims, losses, damages, liabilities, and expenses arising out of your use of the Services, violation of these terms, or infringement of any third-party rights.

8. Changes to Terms

We may update these terms periodically. Continued use of the Services after changes become effective constitutes acceptance of the updated terms. Material changes will be communicated through the Services or by email where reasonably practicable.

9. Governing Law

These terms are governed by the laws of British Columbia, Canada, and the applicable laws of Canada, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Vancouver, British Columbia.
